Privacy and Personal Data Processing Policy

The confidentiality and protection of your personal data is one of the commitments of our company.

Therefore, we pay special attention to this subject in order to ensure the processing of your personal data in accordance with the principles defined in the data protection legislation applicable in Romania, including Regulation (EU) 2016/679 on the protection of natural persons with regard to the processing of data with personal nature and regarding the free circulation of this data, as well as the repeal of Directive 95/46/CE ("GDPR").

Personal data is any information related to an identified or identifiable natural person. An identifiable person is that person who can be identified directly or indirectly, especially by reference to an identification number or to one or more specific physical, psychological, mental, economic, cultural or social identity factors.

This privacy and personal data protection policy concerns the data of our customers, business partners, other people who contact and visit us, as well as their representatives, potential employees, collaborators, users of our products and services, etc. and it applies both to the data collected through the www.paylex.ro web page, as well as to all other personal data collected by e-mail, applications or other offline contacts.

This privacy policy and protection of personal data applies to the company Paylex Consulting, in consideration of its quality as a personal data operator, i.e. for those situations when Paylex Consulting establishes the purpose and means of personal data processing.

Due to the nature of its activity, Paylex Consulting has, in certain situations, the power of attorney of some personal data operators, in which case the personal data processing activities are subject to processing agreements concluded under legal conditions with such operators, for which Paylex Consulting is authorized. This privacy and personal data processing policy does not refer to situations in which Paylex Consulting is authorized by some personal data operators.

This Privacy and Personal Data Protection Policy describes:

  • the purposes for which we collect and use your personal data;

  • the reasons for which we process the data for these purposes;

  • the categories of personal data that we collect and process;

  • the duration of the processing of these personal data;

  • the rights you have as data subjects and how you can exercise them;

  • to whom we disclose or may disclose personal data,

1. Who is responsible for processing personal data? Contact.

The company mentioned above, Paylex Consulting, controls the processing activities of your personal data, as Data Operators, in the sense of EU Regulation 2016/679, regulation available at the address: https://eur-lex.europa.eu/legal-content/RO/TXT/?uri=CELEX:32016R0679.

The company is responsible for ensuring the fulfillment of its obligations to inform the Data Subjects provided for in art. 13 and art. 14 of the GDPR Regulation.

Also, Paylex Consulting SRL is responsible for exercising your rights as data subjects, rights that we invite you to exercise in accordance with those mentioned in point 8 below.

We are committed to always treat your requests with the utmost attention and to answer the questions you have in the shortest possible time, but no later than 30 days from the date of receipt of valid requests.

3. The purposes, grounds of processing and categories of processed personal data

In the context of the interaction with Paylex Consulting, you, as a natural person, may be the subject of the personal data processing activities that we carry out. We therefore use your personal data in the following cases below.

Usually, Paylex Consulting products and services are addressed to companies (B2B). However, you as a natural person, you may find yourself in the situation described in this point 3.1.

3.1 If you are an existing or potential customer or business partner of Paylex Consulting.

3.2 If you are the legal representative or contact person, employee or other collaborator of a client or potential client of Paylex Consulting or of a business partner of Paylex Consulting, in the commercial relationship with Paylex Consulting

The provision of services and products by the company Paylex Consulting

We use your relevant personal data to prepare and provide the services and products requested from us, on your own behalf, or we may use your personal data to manage the relationship with the client you represent. In this case, we rely on the execution of a contract as the basis of personal data processing or on the legitimate interest in providing services in our field of activity and in managing the relationship with our customers as the basis of personal data processing, given that every time you choose the options above, you agree with the terms and conditions of that service.

Communication with you

We use the contact data to communicate with you, in connection with your requests and/or with any other relevant aspects related to the commercial relationship of Paylex Consulting with the entity you represent. Also, in this case, we rely on the execution of the contract or the legitimate interest to provide our services in our field of activity and in the management of the relationship with our clients as the basis of the processing of personal data.

Data processing as an obligation imposed by law

There is the possibility to process some of your personal data in the context of the provision of services based on the legal obligations arising from the legislation that regulates the activity of service providers in the area of human resources management or from other specific legal provisions that govern our activity. In this case, the reasons for processing this data are related to the legal obligation we have.

Sending newsletters

Also, we can use your contact data (e-mail) to provide you with the Newsletter service only if you have subscribed to such a service and, therefore, have previously expressed your explicit consent for such processing of your data

The Newsletter service may contain the following categories of information: news in the field of human resources, information on the legislation applicable in our field of reference, announcements on events and conferences of interest, news on Paylex Consulting products and services.

You can withdraw your consent at any time, expressing your option to no longer receive such information through the following methods: unsubscribing from the newsletter or sending an e-mail to office@paylex.ro.

The categories of data processed in the context of our relationship with you as presented in this point 3.1. or 3.2. it can be your name, e-mail address, telephone, fax, billing data, bank data, data entered in your identity card or passport, position within the company, as well as other personal data of yours that you could give us provide directly or are necessary for the fulfillment of the above purposes.

In all cases, the data is provided either directly by you or by the client/partner.

3.3 If you are applying for a job/internship

With regard to the personal data contained in the CVs we receive in order to fill a position within Paylex Consulting or within the companies for which we provide recruitment services, we use this personal data to assess the qualifications of applicants for such positions, including for a position within the internship or internship programs.

The categories of data processed in the context of our relationship with you are name, e-mail address, telephone, fax, address, personal data included in CVs, details about education and training, professional qualifications, as well as other personal data that you could provide them directly to us.

We base the processing of personal data on your consent expressed once with the transmission of the CV and, subsequently, on the basis of the conclusion and execution of the contract.

3.4 If you are a visitor to our premises

We use your personal data to ensure the security of our premises, goods, and staff within Paylex Consulting. In this case, the processing of our data is based on the legitimate interest of Paylex Consulting, namely the protection of these spaces, assets and personnel.

The categories of data processed in this context are your name, as well as other personal data that you could provide us directly for identification.

3.5 If you are a user of www.paylex.ro

The website www.paylex.ro automatically collects certain information, which it stores in its traffic reports. The information we are talking about may include the IP of the device from which you visit us, the region or general location from where you access the web pages, as well as the type of browser, operating system or device from which you access. We assure you that we do not sell your personal data to any other entity, natural or legal person.

How long do we keep your personal data?

  • We limit the storage period of your personal data to what is necessary for the processing purposes that have been brought to your attention.

  • We are reviewing the need to keep your personal data. Annually, we analyze the collected and processed data, in order to filter, sort and continue processing only for the data whose purpose of processing is current.

  • We delete your personal data:

    • immediately, as a result of a request sent by you, with the exception of data whose processing/supply is required by a legal provision, in which case the retention period will be that stipulated in the applicable mandatory legislation;

    • at the expiration of the contractual terms, if there is no legal obligation regarding the deletion of data and records;

  • It is possible to keep your personal data in the case of establishing, exercising or defending a right in court.

  • If the retention of your personal data is necessary for purposes specified by law, we may continue to retain this data.

How do we ensure the security of your personal data? Are these safe?

  • We ensure the safe keeping of your personal data, by implementing appropriate technical measures and organizational measures suitable for the necessary data protection.

  • In accordance with the applicable legislation, we have defined and implemented internal policies and controls to prevent unauthorized access and inappropriate use of personal data.

  • We use appropriate systems and procedures to protect and secure personal data, specifically aimed at preventing unauthorized/illegal processing, accidental or illegal loss, accidental or illegal destruction.
